These terms and conditions (the “Terms and Conditions”) govern membership in StateRAMP, Inc. dba GovRAMP (hereinafter referred to as “GovRAMP”), and the use of www.govramp.org, hereinafter referred to as the “Site”. This Site is owned and operated by GovRAMP. This Site is intended as a representation of the non-profit organization, outlining the GovRAMP standards and providing education and community for members.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
As a condition of your use of this Site, you will not use the Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Site in any manner that could damage, disable, overburden, or interfere with any other party’s use and enjoyment of the Site.
Intellectual Property
All content published and made available on our Site is the property of GovRAMP and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
GovRAMP makes every effort for the content on the Site to be correct, current, and complete; however, you should confirm the accuracy and completeness of all posted information before making any decision related to any services, products, or other matters described in the Site.
Accounts
When you create an account on our Site, you agree to the following:
- You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account. You agree that you are solely responsible to us for all activities identified with your account. You agree to immediately notify GovRAMP of any unauthorized use of your username or password or any other breach of security. You must logout from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. GovRAMP has the absolute right to disable any username or password, at any time, for any reason, including, if in our sole discretion, we believe that you have failed to comply with any provision of these Terms.
- All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
- You agree that you are solely responsible for any activity associated with your account and any Information that you submit or otherwise upload to the Site, if applicable. By uploading any such Information to the Site, you hereby grant GovRAMP a non-exclusive, fully paid, and royalty-free right and license to use any such Information only for GovRAMP’s business purposes.

All Information submitted via the Site is hosted by a third-party service provider, not GovRAMP, and GovRAMP shall have no liability whatsoever for the security or storage of such Information. You understand that the Site is neither intended nor designed for the uploading, collection, storage or protection of any protected health information (“PHI”) governed by the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”), nor does it need or request any non-public consumer personally identifiable information or financial information governed by the Gramm-Leach-Bliley Act (“GLBA”) or payment card information covered by the Payment Card Industry Data Security Standards (“PCI DSS”). You should never disclose, or allow to be disclosed, PHI, information protected by PCI DSS or GLBA, or other sensitive information to GovRAMP. In the event that you disclose such information (which would be a violation of these Terms), you, on behalf of your organization, acknowledge that GovRAMP does not take steps to ensure its products are HIPAA or PCI compliant. All obligations of the aforementioned regulations remain solely with you.
- If registering to represent a Third Party Assessment Organization, you attest that you represent an A2LA-accredited, FedRAMP-approved organization listed on the FedRAMP Marketplace as a third party assessment organization in good standing with FedRAMP; you are fully equipped to conduct independent assessments of IaaS, SaaS, and PaaS solutions; and that all information provided through this site (“Site”) is complete and accurate.
- GovRAMP reserves the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
- If registering to represent a Third Party Assessment Organization, you attest that you represent an A2LA-accredited, FedRAMP-approved organization listed on the FedRAMP Marketplace as a third party assessment organization in good standing with FedRAMP; you are fully equipped to conduct independent assessments of IaaS, SaaS, and PaaS solutions; and that all information provided through this site (“Site”) is complete and accurate.
- You agree to use the technology, tools, templates, and documents provided by GovRAMP to complete the necessary GovRAMP membership information. You agree to upload all requested information (“Information”) into the GovRAMP Site.
Membership Accounts
The annual membership dues amount applicable to each membership type, may be found on the Site. Membership dues must be paid in full when the membership is purchased.
- Dues Cycle: GovRAMP membership begins on the day it is purchased and is valid until May 31st of that year. Annual memberships run on a yearly cycle from June 1 through May 31st.
- Renewal: Dues invoices are payable on the date of membership expiration. Dues may automatically increase in subsequent years, in accordance with GovRAMP policy and procedure. Renewal of membership constitutes acceptance of the new fee.
- Suspension: Members whose dues are not paid within 30 days of their due date will be considered past due and all services will be suspended. Membership privileges will be reinstated after full payment is received. Past due invoices for other services rendered will also be causes for suspension, even if membership dues have been paid in full. This includes, but is not limited to, past due continuous monitoring and annual review or fees. Membership will be reinstated after full payment of an outdated invoice is received.
- Termination: Members who have not paid their membership dues may be terminated after six months of suspension. Terminated members can apply for a new membership but payment must be received before membership becomes active, including any past due invoices for other services rendered.
- Cancellations and Refunds: No full or partial refunds will be given for unused membership services. Cancellations may only be requested within 72 hours of applying for membership.
Payments
We accept the following payment methods on our Site:
Credit Card, Check, or ACH
When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Consumer Protection Law
Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL GOVRAMP AND OUR DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, SUBSIDIARIES, AND AFFILIATES BE LIABLE FOR ANY TYPE OF DAMAGES OR CLAIMS RELATED TO THE SITE, INCLUDING BUT NOT LIMITED TO, INCIDENTAL, SPECIAL, PUNITIVE, INDIRECT OR CONSEQUENTIAL DAMAGES, OR LEGAL FEES EVEN IF GOVRAMP OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless GovRAMP and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the State of Indiana.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and all applicable laws and regulations. GovRAMP reserves the right to terminate or modify the Site including any of its content, in whole or in part, in any manner in GovRAMP’s sole discretion, without notice. Access to the Site is granted at GovRAMP’s sole discretion and may be revoked at any time. GovRAMP may change the Terms and Conditions from time to time to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. These changes are at GovRAMP’s sole discretion. We will notify users of changes to these Terms and Conditions by posting a notice on our Site.
